Privacy Policy

Yoga Journey HK Limited (“Yoga Journey HK”) is absolutely committed to the protection of privacy and to fully implementing and complying with the relevant provisions of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong). “Personal Data” in this notice has the same meaning as “personal data” in the Personal Data (Privacy) Ordinance.

Personal Information Collection

Yoga Journey HK collects different information in order to help us improve the services and products we offer; and to provide unique personalized services and products to each visitor/registrant.

The supply of your Personal Data to the Company is on a voluntary basis and such data will be used for processing your instructions and requests.

You are under no obligation to provide your complete Personal Data. However, the information we required will be able to provide you with our products and services. Yoga Journey HK may also ask for further information from you in order to obtain a better understanding of how Yoga Journey HK can provide personalized services to you, in all instances it is entirely your choice whether or not to provide information, in some case for us to provide the service requested, you will be required to give certain information, whether you do or not is your choice. Obviously if you do not, then we may not be able to provide the services requested, in all cases when you are required to give information we will inform you. We will inform you in cases when it is obligatory for you to provide information before you can receive the service requested.

Types of Information we may collect:

• Your attendance record and purchase history

• Your name, residential and correspondence address, contact number (e.g. mobile phone number or office number), fax number, emergency contact person and his/her number, email, country, gender, marital status, identity card or passport number, profile photo, designation, company name and address

• Your credit card details, payment details including type of payment

• Your plan and goal in relation to yoga

• How you heard of Yoga Journey HK

• Community discussions, correspondence through our sites, websites and correspondence sent to us

• Other information from your interaction with our websites, sites, services, and content, including computer and connection information, statistics on page views, traffic to and from the websites, ad data, IP address and standard web log information

We use your Personal Data:

• To process your application and registration

• To process your contract renewal and upgrade

• To ascertain if you are eligible for discounts (if any)

• To conduct market research and analysis

• For direct marketing

• For other related purpose

Direct Marketing

We intend to use your phone number, mailing address, facsimile and email in direct marketing activities such as update and promotion of our yoga, wellness, fitness and retail services, e-newsletters, package renewal and/or upgrades (including but not limited to renewal of yoga packages and others) and any other services or updates.

Cookies

Cookies are small pieces of information which are stored by your browser on your computer. Many websites generate cookies which will be stored on your hard drive so that on subsequent visits to that site it will recognize that you have previously used that site and make it easier for you to use that site.

Yoga Journey HK websites uses two types of cookies:

• Temporary cookies which remain in the cookie file of your browser until you have finished that particular visit to Yoga Journey HK websites, and which allow you ease of use of our websites and avoid you having to re-enter information and the like.

• Persistent cookies help us to compile statistics about the number and type of visits to our websites.

This Privacy Policy is written in English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of this Privacy Policy, the English version shall prevail.

In using websites of Yoga Journey HK Limited (“Yoga Journey HK”), you are agreeing to be legally bound by these terms as modified from time to time (the “Terms”). Before using Yoga Journey HK websites (the “Websites”), it is your responsibility to read Yoga Journey HK’s Privacy Policy and to inform Yoga Journey HK if you do not want us to collect information about you, and reject any cookies.

The Websites are owned and operated by Yoga Journey HK reserves the right to suspend or to terminate your access to the Websites at any time, with or without notice.

All intellectual property rights, including copyright, in the content displayed on the Websites (the “Content”) belong to Yoga Journey HK or its licensors.

The Websites and the Content may only be used for your personal, non-commercial use. Yoga Journey HK contains links to other web sites operated by parties who are wholly separate from Yoga Journey HK. Such links are provided for your convenience and reference only and Yoga Journey HK cannot be held responsible in any way for the content, operation or availability of such websites.

Disclaimer of Warranties and Limitation of Liability

Yoga Journey HK obtains the Content from a wide range of sources and it includes facts, views, opinions and information likely to be of interest to users of the Websites.

While all reasonable care is taken, we do not guarantee the accuracy, completeness, timeliness, performance or fitness for any particular purpose of the Websites and the Content nor do we endorse or accept any responsibility for any views, advice, recommendations or opinions expressed on the Websites or any website to which we link.

The Content should only be used for your general information and use and not by way of specific recommendation or advice as your circumstances are different to other users.

Yoga Journey HK shall not be liable for any claims, losses, injuries, penalties, damages, costs or expenses arising from your use of, or inability to use the Websites or the Content or from any action taken, or omitted to be taken, as a result of using the Websites or the Content.

To the fullest possible extent allowed by law, you agree that Yoga Journey HK will not be liable to you and/or any other person for any consequential or incidental damages (including but not limited to loss of profits, loss of privacy or for failure to fulfill any duty) or for any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of the Websites or the Content or to any breach of the Terms by Yoga Journey HK.

You agree that your exclusive remedy, shall be limited to the direct damages (if any) which you actually incur in reasonable and exclusive reliance on the Websites or the Content, and for which we may be held liable by a competent court, of up to a limit of the refund of the amount you paid (if any) in relation to the particular use of the Websites or the Content in total during the month in which the damage first incurred.

Changes to these Terms

Yoga Journey HK reserves the right to make changes to any part of the Websites and to add to or change these Terms or the Privacy Policy. It is your responsibility to refer to the Terms whenever you access the Websites. Every time you access the Websites you agree to be bound by the Terms and the Privacy Policy as varied or amended from time to time.

We also reserve the right to change terms and conditions of our classes and programmes without prior notice. You accept these conditions once you enrol in our classes and programmes.

Hong Kong Law

By accessing the Websites, you agree to accept that these Terms are governed by and construed in accordance with the Laws of Hong Kong. You also accept the exclusive jurisdiction of the Court in relation to any dispute that may arise in connection with these Terms or your use of Yoga Journey HK Yoga websites or arising in any way from the Content.

These Terms are written in English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of these Terms, the English version shall prevail.

All classes will need to be booked 2 hours before class starts. If you wish to cancel the class that you've booked, please cancel it 6 hours before class starts.

For no-show or late cancellation, class credit will be deducted or for unlimited pass holder, you will be restricted to booking for the next 2 days.

If you no longer have any of the pass to be deducted, we will charge extra HKD200 from you as penalty.

At Yoga Journey, we understand the value of small class sizes for our students' experience. However, we must also consider the financial constraints that affect our ability to provide these classes. As a result, we have established guidelines for class enrollments to ensure the sustainability of our studio.

Minimum Class Size

Starting from October 2023, our classes will require a minimum enrollment of 2 students to be conducted. If a class does not meet this minimum enrollment, it may be subject to cancellation.

Class Cancellations

If a class does not meet the minimum enrollment requirement of 2 students and does not fall under any exceptions, we reserve the right to cancel the class. To ensure that our students are informed promptly, any cancellations will be communicated via the email address provided during class registration.

Cancellation Notice

We kindly request that you cancel your class reservation at least 6 hours in advance if you are unable to attend, especially if the class size falls below the minimum requirement. This allows us to better manage our class schedule and accommodate all our students effectively.
